Eligible Participants
The Challenge is open to 501(c)3 IRS registered nonprofit organizations incorporated or organized within, located in, and serving in Metro Detroit, Michigan, Metro Cleveland, Ohio, Metro Phoenix, Arizona or outside of these previously specified locations, (b) serving neighborhoods, public safety, activate and animate the city, local entrepreneurship, human services and/or education and youth (the “Purpose”), and have been invited by Sponsor to participate in this giving event and the bonuses included. Please note that private non-operating foundations are not eligible to participate.
Two (2) or more nonprofits that are distinct and have unique Employer Identification Numbers (“EINs”) or business numbers, as the case may be, may not share one Campaign (as defined below) page or otherwise combine efforts or resources in order to increase their odds in the Challenge. If you are an individual submitting an entry and agreeing to these Official Rules on behalf of a legal entity, you represent and warrant that (i) you are an authorized representative of such entity and able to legally bind such entity or that you have permission from such entity to submit an entry on its behalf and (ii) have read, and hereby agree to, these Official Rules on behalf of such entity. All entries made in connection with the Challenge are governed by these Official Rules and are subject to verification of eligibility before a grant is awarded. Sponsor and Mightycause and their respective parents, affiliate companies, subsidiaries, agents, judges, advertising and promotion agencies and anyone involved in the development of the Challenge, are not eligible. Employees, independent contractors, officers, and directors, of Mightycause as well as the immediate family (spouse, parents, siblings, and children and their respective spouses, regardless of where they live) and household members of each such employee, whether or not related, are not eligible. Entries that are submitted in connection with the Challenge will only be eligible if (A) the entrant’s Campaign (as defined below), and related content posted by the entrant, does not contain content that is unlawful, hateful or obscene, in the Sponsor’s and/or Mightycause’s discretion, and (B) the funds from the Campaign are being used, and will continue to be used, solely for the Purpose (as defined above). By participating in the Challenge, you warrant that you are eligible to participate in accordance with these Official Rules.
Eligible Donations
Eligible donations are those donations that comply with all terms and conditions contained herein. Only eligible donations may count toward the total amount raised by each entrant’s Campaign. Donations must be made online by a credit card, debit card, Apple Pay, Google Pay ACH, PayPal, Venmo or the Sponsor’s Payroll Deduct Service through the Challenge website during the Challenge Period in order to count towards an organization’s Campaign total. The minimum donation amount is $5, and there is no maximum donation amount for donations made by a credit card, debit card, Apple Pay, Google Pay, ACH, PayPal or Venmo.
Ineligible Donations
Cash or check donations (“offline donations”) do not count towards an organization’s Campaign total. Donations must be successfully processed within the Challenge Period via the organization page link provided to each eligible participant under https://www.rocketcommunitychallenge.com/organization/[YOURNONPROFITNAME] (the “Challenge Website”) to count towards an organization’s Campaign total. Any donation made outside of the Challenge Period will still be sent to the designated 501c3 organization but will not count towards that organization’s Campaign total.
Any donation received outside of the Challenge Website will not be counted towards the Challenge. An organization may not make a donation to its own Campaign to help secure a prize. Only the authorized credit card holder may donate on the Challenge Website. A third party may not use the donor's card information or enter donations on behalf of the donor. Proxy donations (employees making donations using the organization's credit card to the Campaign page) are also not allowed. Any individual may donate. Donations made through the Challenge Website to participating organizations are 100% tax deductible and irrevocable. Credit Card donations will not be refunded.
Conduct and Compliance
The Challenge is a benefit of the generosity provided by the Sponsor. Participating nonprofit organizations are expected to conduct themselves in the spirit of the campaign by abiding by these Official Rules or other instructions of Sponsor or Mightycause. Any entrants that are found to be manipulating or exaggerating their results to secure a prize by utilizing deceitful or duplicitous behavior including but not limited to, forged email addresses, proxy donations, and donating on behalf of a donor, may result in disciplinary action. The Sponsor reserves the right to disqualify an organization that does not abide by these rules from a specific Bonus Challenge, the overall Challenge and/or any future Challenges. Any disqualification decisions will be made at the Sponsor’s sole and absolute discretion.

Each participating organization will be eligible for 1 Grand Prize, along with 2 Bonus Challenges. Once an organization has won 2 Bonus Challenges, they will be ineligible for future Bonus Challenges.

Except where prohibited, participation in the Challenge constitutes each winner’s consent to Sponsor’s and Mightycause and their respective agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for advertising, promotional, and other purposes in any manner, in any and all media, now known or hereinafter devised, worldwide, in perpetuity, without further payment or consideration, notification, or permission (unless prohibited by law), and by participating in the Challenge, you further agree to execute any specific consent needed or requested by Sponsor, Mightycause or their respective designees in furtherance of such use. Additional paperwork, releases, background checks or screenings, to the extent allowed by law, may also be required before a prize can be awarded.

A matching grant is a donation a nonprofit uses to leverage additional donations through the Challenge Website. Any matching grant funds will not be eligible for Grand Prizes or Bonus Challenges unless the matching donor chooses to make their donation online via the Challenge Website.

MCF is a registered 501(c)(3) nonprofit which operates a donor advised fund to handle donor advised contributions made using the Challenge website. Donor Advised Fund (“DAF”) is defined by IRC Section 4966(d)(2) as a fund or account (i) which is separately identified by reference to contributions of a donor or donors, (ii) which is owned and controlled by a sponsoring organization, and (iii) with respect to which a donor (or any person appointed or designated by such donor) has, or reasonably expects to have, advisory privileges with respect to the distribution or investment of amounts held in such fund or account by reason of the donor’s status as a donor. Federal law prohibits charities from promising or providing goods and services (e.g., tickets to events or raffles) in exchange for making a donation to a donor advised fund such as Mightycause Charitable Foundation. Mightycause Charitable Foundation may only accept pure contributions and not part gift and part sale transactions.

Sponsor can modify any restrictions or conditions if, in the sole judgment of Sponsor, such restriction or condition becomes unnecessary, incapable of fulfillment or inconsistent with the charitable needs of the community. As such, Sponsor reserves the right to deny or condition the distribution of prize grants if, in its sole judgment, such restriction or condition becomes necessary.
Sponsor reserves the right to modify, suspend, cancel, or discontinue any Challenge at any time for any reason, including without limitation to comply with applicable laws, rules, and regulations, and to take any actions Sponsor deems necessary, in its sole discretion, to protect its users, business partners, or business or the public or if any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor’s or Mightycause’s control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Challenge. In the event of such cancellation, termination or suspension, Mightycause will use reasonable efforts to post a notification and, if winner(s) can be selected among all eligible, non-suspect entries received prior to such time, winner(s) will be selected.
Sponsor and Mightycause, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, shareholders, partnership, members, principals, employees, agents, contractors or suppliers (collectively, “Released Parties”) are not responsible for late, lost, stolen, damaged, garbled, incomplete, mistyped, misaddressed or misdirected entries, emails, mail or communications; for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices; or for transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise; or for any delays in payment processing. Further, Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's email account to receive email messages or insufficient space on entrant’s computer. The use of automated software or computer programs to register or to enter the Challenge is prohibited, and any entrant who uses or attempts to use such methods to register or to enter will be disqualified. Released Parties disclaim any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, the Challenge. Sponsor and Mightycause reserve the right to disqualify any entrant (and his/her Challenge entry) from the Challenge, any other promotions conducted now or in the future by Sponsor or Mightycause or any of their affiliates if such entrant tampers with the entry process or if such entrant’s fraud or misconduct affects the integrity of the Challenge or if such entrant engages in any inappropriate or unacceptable behavior in connection with the Challenge. Sponsor and Mightycause reserve the right to correct clerical or typographical errors in promotional materials, including without limitation these Official Rules.
By participating in the Challenge, each entrant releases and holds harmless the Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy, arising out of participation in the Challenge or entries that are ineligible (including, if entry is made by donation, if not processed prior to the end of the Challenge Period). By accepting the prize, winner(s) agrees to release Released Parties and their directors, employees, officers and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt and/or use or misuse of prize or participation in any prize-related activity. All Challenge participants acknowledge and agree that normal Internet access, phone and usage charges imposed by their online, phone or similar providers may apply in order to participate in the Challenge and accept the prize.
Any controversy or claim arising out of or relating to this Challenge shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Michigan law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties.
THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY SET FORTH ABOVE, SO SUCH LANGUAGE MAY NOT APPLY TO EVERY ENTRANT.
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. This Challenge and its Official Rules are governed by US law and are subject to all applicable federal, state and local laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Challenge, shall be governed by, and construed in accordance with, the laws of the State of Michigan, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 7 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in Michigan, in the County of Wayne.
IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE ANY AND ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF THE STATE OF CALIFORNIA, WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”
Sponsor can modify any restrictions or conditions if, in the sole judgment of Sponsor, such restriction or condition becomes unnecessary, incapable of fulfillment or inconsistent with the charitable needs of the community. As such, Sponsor reserves the right to deny or condition the distribution of prize grants if, in its sole judgment, such restriction or condition becomes necessary.
Sponsor reserves the right to modify, suspend, cancel, or discontinue any Challenge at any time for any reason, including without limitation to comply with applicable laws, rules, and regulations, and to take any actions Sponsor deems necessary, in its sole discretion, to protect its users, business partners, or business or the public or if any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor’s or Mightycause’s control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Challenge. In the event of such cancellation, termination or suspension, Mightycause will use reasonable efforts to post a notification and, if winner(s) can be selected among all eligible, non-suspect entries received prior to such time, winner(s) will be selected.
Sponsor and Mightycause, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, shareholders, partnership, members, principals, employees, agents, contractors or suppliers (collectively, “Released Parties”) are not responsible for late, lost, stolen, damaged, garbled, incomplete, mistyped, misaddressed or misdirected entries, emails, mail or communications; for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices; or for transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise; or for any delays in payment processing. Further, Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's email account to receive email messages or insufficient space on entrant’s computer. The use of automated software or computer programs to register or to enter the Challenge is prohibited, and any entrant who uses or attempts to use such methods to register or to enter will be disqualified. Released Parties disclaim any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, the Challenge. Sponsor and Mightycause reserve the right to disqualify any entrant (and his/her Challenge entry) from the Challenge, any other promotions conducted now or in the future by Sponsor or Mightycause or any of their affiliates if such entrant tampers with the entry process or if such entrant’s fraud or misconduct affects the integrity of the Challenge or if such entrant engages in any inappropriate or unacceptable behavior in connection with the Challenge. Sponsor and Mightycause reserve the right to correct clerical or typographical errors in promotional materials, including without limitation these Official Rules.
By participating in the Challenge, each entrant releases and holds harmless the Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy, arising out of participation in the Challenge or entries that are ineligible (including, if entry is made by donation, if not processed prior to the end of the Challenge Period). By accepting the prize, winner(s) agrees to release Released Parties and their directors, employees, officers and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt and/or use or misuse of prize or participation in any prize-related activity. All Challenge participants acknowledge and agree that normal Internet access, phone and usage charges imposed by their online, phone or similar providers may apply in order to participate in the Challenge and accept the prize.
Any controversy or claim arising out of or relating to this Challenge shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Michigan law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties.
THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS CHALLENGE IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.
